A water damage incident on a Sunday evening, and we discover that the deductible exceeds what we imagined. Or worse: that the compensation ceiling barely covers half of the damaged furniture. The choice of insurance is rarely made at the time of subscription, but almost always at the time of the claim. Choosing the right insurance means anticipating these concrete situations before they occur.

Natural disaster surcharge and regulatory guarantees: what escapes comparison

When comparing home insurance quotes, we focus on the overall premium. However, part of this premium is not subject to any negotiation.

As of January 1, 2025, the surcharge rate related to natural disaster coverage has increased from 12% to 20% of the concerned premium, in accordance with the decree of December 22, 2023. This rate applies uniformly across all insurers: changing contracts does not reduce this regulatory portion.

This mechanism has a direct consequence on the interpretation of quotes. If one insurer displays a significantly lower rate than another, the difference does not pertain to natural disaster coverage, but to contractual guarantees (theft, glass breakage, electrical damage). This is where the comparison makes sense.

We can delve deeper into the topic by consulting insurance on Invistita, which details the different types of contracts and their specificities.

Another often misunderstood point: natural disaster coverage does not automatically trigger after a storm or flood. A ministerial decree must recognize the state of natural disaster for the affected municipality. Without this official recognition, we depend solely on the contractual guarantees of the policy (storm, hail, snow), whose ceilings and deductibles vary greatly from one insurer to another.

Insurance coverage exclusions: clauses that change everything at the time of the claim

The general conditions of an insurance contract often span several dozen pages. We skim through them, sign, and pull them out the day something happens. The problem is that coverage exclusions are hidden within these pages.

Take a common case: home insurance covers theft but excludes break-ins if the door was not locked at the time of the incident. Some contracts add conditions regarding the type of lock or the presence of an alarm system. If these conditions are not met, compensation is denied.

Clauses to check as a priority before subscribing

  • The uninhabited clause: for a second home or an unoccupied dwelling for more than 30 to 90 consecutive days (the threshold varies by contract), certain theft or water damage guarantees are suspended without notice
  • Compensation ceilings by category of goods: a correct overall ceiling may mask a very low sub-ceiling on valuable items, computer equipment, or jewelry
  • The method of compensation (new value or actual value): the difference between the two can represent a significant portion of the reimbursement for furniture or appliances a few years old
  • Waiting periods: for legal protection or insurance, effective coverage may only start several months after subscription

Reading the exclusions before comparing prices prevents paying for theoretical coverage that does not apply in practice.

Insurer’s duty to advise: a strengthened obligation since the end of 2025

We often think it is up to us to understand what we are signing. Regulations say otherwise.

The ACPR recommendation 2024-R-03, published on November 21, 2024, became applicable to all relevant insurance products starting December 31, 2025. It is no longer limited to life insurance: the collection of client needs and the written justification for the advice are now required for all contracts.

In practice, this means that the insurer or broker must ask questions about the personal situation, the assets to be covered, specific risks, and then justify in writing why a particular contract is recommended over another. If this step is rushed or absent, it is a lever in case of dispute.

What can be concretely demanded

When subscribing in an agency or by phone, one can request a written document summarizing the advice given and the reasons for the proposed choice. For remote subscriptions, keeping a record of exchanges (emails, call recordings) strengthens the position in case of dispute.

This duty to advise does not replace personal vigilance. An insurer may recommend a contract suited to the declared profile, but if the information provided is incomplete or inaccurate, coverage may be contested at the time of the claim.

Home insurance cancellation: leaving without waiting for the anniversary date

Historically, changing home insurance meant waiting for the contract anniversary date and respecting a notice period. This mechanism hindered mobility and discouraged regular comparison.

Annual cancellation, made possible by the Hamon law for home and auto insurance, allows you to cancel at any time after the first year of the contract, without fees or penalties. The new insurer takes care of the procedures with the old one.

This right changes the way to approach the initial choice. One can subscribe to a contract that seems suitable, then question it a few months later if the guarantees prove insufficient or if a more relevant offer appears. The challenge is no longer to find the perfect contract at the first attempt, but to reassess coverage each year based on changes in one’s situation: moving, acquiring assets, changing family status.

The reflex to adopt: review your guarantees at least once a year, compare with two or three competing quotes, and check that the ceilings still match the actual value of the insured assets. A relevant contract at subscription can become unsuitable in a few years without us realizing it.
